Ward, Damon & Posner PA has been engaged to file a lawsuit on behalf of Earl Stewart Toyota, seeking damages for slander and damages resulting from alleged violations of the Florida Deceptive and Unfair Trade Practices Act.  The suit stems from Ed Morse Honda’s radio ad alleging that Earl Stewart Toyota is hiding dealer fees.  To the contrary, Earl Stewart has been a leading advocate for the elimination of dealer fees.  Dealer fees are generally undisclosed to car buyers and are 100% profit to the dealers. The fees have been outlawed in a number of states and are viewed as deceptive to consumers.  Litigation partner Michael Weeks has drafted and filed the complaint which also seeks a declaratory judgment that dealer fees are a deceptive trade practice. While Earl Stewart pledges to donate anticipated damages to local charity, he also anticipates that the elimination of dealer fees will save consumers millions of dollars.
